Intentional Torts


Intentional torts occur when the defendant intended to commit the tort.

  • share many common elements with a crime
  • same action can be both a wrong against society (a crime) and a wrong against an individual (a tort)
  • classic example:
    • battery
  • Battery is harmful or offensive contact with another person

Defense

  • most common defense:
    • plaintiff consented to the wrongful action
