Intentional Infliction of Emotional Distress (IIED)
Intentional infliction of emotional distress (IIED) is when conduct that is so offensive that a reasonable person would say “Outrageous!”
- known as the tort of outrage
Proving
- plaintiff must show:
- defendant acted intentionally or recklessly
- defendant’s conduct was extreme and outrageous
- defendant’s conduct caused the plaintiff severe emotional distress
Outrageous Conduce
- outrageous conduct is “beyond all possible bounds of decency and to be regarded as atrocious, and utterly intolerable in a civilized community.”
